Data Ownership Policy

Malaysia Horizontal Directional Drilling Association (MyHDD)

1. User Responsibility and Data Integrity

Any user or member who uploads technical documents, reports, or project data to the MyHDD Website Portal bears full and sole responsibility for the originality, authenticity, and technical accuracy of the files. By submitting data, the user warrants that they possess the legal right to share such information and that the content does not infringe upon any third-party intellectual property or confidentiality agreements.

2. Shared Ownership and Grant of Rights

Upon successful upload to the portal, the user agrees to a shared ownership model with MyHDD. While the contributor retains their original rights, they grant MyHDD an irrevocable, perpetual, and royalty-free right to edit, modify, remove, or reuse the data for the purpose of industry research, safety benchmarking, and the development of national HDD standards. MyHDD reserves the absolute right to sanitize or delete data that is found to be inaccurate, obsolete, or in violation of association policies.

3. Portal-Generated and Consolidated Data

All data compiled, processed, or generated by the portal's internal systems—including membership analytics, certification records, and industry-wide technical benchmarks—remains the exclusive property of MyHDD. Users are strictly prohibited from scraping, redistributing, or selling any consolidated data harvested from the portal without express written consent.

4. Subsurface Safety and Public Interest

Data pertaining to subsurface conditions and underground utility mapping is treated as a critical asset for public safety and damage prevention. MyHDD acts as a custodian of this data; we reserve the right to share non-sensitive technical insights with regulatory bodies (such as CIDB or local authorities) to enhance the safety of Malaysia's trenchless ecosystem.

5. Data Archive and Permanent Record

To maintain the integrity of the national HDD knowledge base, technical files contributed to the portal will remain in the MyHDD permanent archive even after a user's membership has expired or been terminated. This ensures that historical project data remains available for future safety audits and technical reference.

6. Security and Liability Disclaimer

While MyHDD employs high-level digital encryption and security protocols to protect the portal, we do not assume liability for data loss due to unforeseen technical failures or unauthorized external breaches. Users are encouraged to maintain independent backups of all critical documentation.
